Grothman introduces bill opposing labor rule affecting disabled workers

Congressman Glenn Grothman from Wisconsin has put forward the Continuing Opportunities for People with Disabilities to Excel Act. This proposed legislation aims to prevent a new rule by the Department of Labor (DOL) that could result in the shutdown of Community Rehabilitation Providers (CRPs) such as Northwoods Incorporated of Wisconsin, Ascend Services, Incorporated, and Brooke Industries, Incorporated. The act is supported by A-Team USA, an advocacy group for individuals with disabilities.

The DOL announced on December 3, 2024, its intention to phase out 14(c) certificates. These certificates are crucial for CRPs and families nationwide as they provide employment opportunities for people with disabilities. Without them, these individuals might be left with no choice but to attend day services or face isolation at home.

Grothman stated, “I am proud to introduce the Continuing Opportunities for People with Disabilities to Excel Act. Under my bill, individuals with disabilities will be protected and empowered through the preservation of their right to choose the workforce program they think will best suit their needs.” He emphasized that employment benefits extend beyond just the employees themselves.

Section 14(c) of The Fair Labor Standards Act allows employers to pay a commensurate wage based on productivity after obtaining a certificate from DOL. This provision sometimes enables workers with disabilities to earn more than minimum wage. Besides financial gain, these jobs offer a sense of belonging and social interaction in a secure environment. They also foster long-lasting friendships among peers and management staff.
